Nominated candidates who fail the leadership and integrity tests despite getting nomination papers from their respective parties risk being barred by the Independent Electoral and Boundaries Commission (IEBC).
Through a statement, the Commission’s Chairperson Wafula Chebukati pointed out that aspirants who are disqualified to run for an elective seat election under the Constitution Elections Act of 2011, or any other written legislation will have their candidacy rejected.
Elections Act of 2011 section 25, Part III—Elections 13. (2) states that a political party shall not change the candidate nominated after the nomination of that person has been received by the Commission: Provided that in the event of the death, resignation, or incapacity of the nominated candidate or of the violation of the electoral code of conduct by the nominated candidate, the political party may after notifying the candidate that the party seeks to substitute, where applicable, substitute its candidate before the date of presentation of nomination papers to the Commission.
This comes after former Governors Mike Sonko (Nairobi) and Ferdinand Waititu (Kiambu) made a political comeback despite having been impeached and pending court cases.
Political parties are expected to submit the names of persons nominated to contest in the polls on or before April 28, 2022.
Orange Democratic Movement (ODM) and United Democratic Alliance (UDA) have so far carried out nominations in different counties.
