The Ethics and Anti-Corruption Commission(EACC) has dismissed reports that it sent police officers to raid Senior Counsel John Khaminwa’s office over his submissions in the Building Bridges Initiative(BBI) appeal case.
This cames after Khaminwa on Saturday spoke to media at his offices saying two individuals from EACC visited his office to intimidated him.
In a tweet, the commission denied conducting any operation on Saturday and declared the media reports unfounded.
“EACC wishes to notify the public that it did not conduct any operation yesterday and media reports suggesting that EACC visited the offices of John Khaminwa Senior Counsel are unfounded,” tweeted the commission.
According to Khaminwa, the two individuals visited him on Saturday morning to intimidate him and to take advantage of what he said in court.
“I stand by what I said at the Court of Appeal… what I said was truthful,” he said.
Khaminwa said that although the two officers said they were state officials, they may not have been sent directly by the state.
He went on to say the officials asked his assistant for money.
In his submission to the Court of Appeal on the BBI case on Friday, Khaminwa said that the President has not come to the court with clean hands, therefore the court must refuse to hear him for deliberately refusing to swear in the six judges.
Appearing for the Kenya Human Rights Commission (KHRC) and Kituo Cha Sheria, he said it was double-standard from the President to mistreat judges seconded to the appellate court and at the same time appear before their would-be colleagues to hear him.
“If you have a president who demeans judges and disobey court orders, the court must stand its ground and say no to him,” he said.
Citing the Kisumu situation, he argued that the President failed to promote two High Court judges who nullified the BBI.
“While he was at Kisumu, he made certain remarks about judges. My Lord, he has failed to promote High Court judges who nullified the BBI (Justices Joel Ngugi and George Odunga). When you come to the court you must come with clean hands, the president has not come to this court with clean hands at all,” Khaminwa argued.
