A Nairobi Magistrate’s Court has sentenced a General Service Unit (GSU) officer to 15 years in prison after he was found guilty of rape.
Anthony Ongere Moseti alias Kelvin was arraigned in court on charges of rape back in 2018 after an investigation by the authority but denied the charges.
Detectives would immediately launch investigations after a complaint lodged with the Authority following the Independent Policing Oversight Authority (IPOA) over the unfortunate incident, which occurred at the GSU headquarters on February 9, 2017.
The investigation established criminal culpability and consequently, IPOA forwarded the case file to the Office of the Director of Public Prosecutions.
Sleuths handling the matter recommended that the officer be arraigned for the offence of rape, contrary to Section 3 of the Sexual Offences Act.
The ODPP independently reviewed the file and gave the green light to charge the officer, having concurred with the authority that there was sufficient evidence to sustain a trial in a court of law.
Magistrate CM Njagi would go on to convict the officer on Friday, having found him guilty of the offence.
“The accused indeed committed the heinous act upon the complainant twice without her consent.
I do find that this case was proved to the required standard as to the offence of rape as charged,” the magistrate ruled.
IPOA reported that the incident happened on February 9, 2017, when the woman visited the GSU headquarters in Ruaraka after she was called by the officer, who was well known to her.
The agency is mandated to investigate any complaint whether criminal or disciplinary against any member of the National Police Service.
