Car dealer Kairu charged with annother new matter of obtaining money falsely

Recently charged with other two similar matters

Controversial car dealer Joseph Kairu Wambui alias Khalif Kairu has been charged in a Nairobi court with cheating contrary to Section 315 of the Penal Code and securing KSh 3 million.

Kairu who has been recently charged with other two similar matters appeared before the Milimani Chief magistrate Lucas Onyina where he denied the charges levelled against him.
The prosecution told the court that on diverse dates between October 5 and 7, 2024, at Westlands Business Park in Westlands sub-county in Nairobi county by means of fraudulent tricks obtained Ksh 3,045,000 from Dan Odhiambo Odundo by falsely pretending that he was in a position to to import him a mortor vehicle make Volkswagen Tiguan 1.4 Line from.Japan through his company known as Kai and Karo Limited a fact he knew to be false.
The Prosecution led by Irene Magola did not oppose the release of the accused person but prayed the court to give terms that commensurate the amount involved.
“Your honour we do not oppose the release of the accused person on bond but I pray the amount to commensurate to the offence,” Magola told the court.
She informed the court that the accused person has two other matters of the similar nature where mention of one of them is on January 31, 2025.
Magola urged the court not to consolidate the matters and prayed each file to stand alone and give new bond terms in the current matter.
She finally put court on notice that in previous charges there were conditions placed upon the accused and his lawyer by the Director of Public Prosecution (DPP) which need to be adhered.
The defence lawyer Felix Makau prayed the court to release the accused person on personal bond considering he has other two matters pending in court with cash bail of KSh 2 million.
He told the court to consider the accused has been exhausted to bring sureties and cash bail which might turn to be a burden and fail to pay,
“Your honour my client is out on cash bail of KSh 2 million in other matters and he might lack sureties and cash bail to secure his freedom.
In response, the state prosecutor opposed the accused person to be released on personal bond.The accused was detained in custody awaiting the ruling on bond application tomorrow at 9:00 o’clock in the morning.
