Former Nairobi governor Evans Kidero has appealed to the Independent Electoral and Boundaries Commission (IEBC) to provide him access to specific papers to overturn Homa Bay governor Gladys Wanga’s victory.
Through his attorney, Okweh Ochiando and Company Advocates, Kidero requested access to ballot items that were utilised in the most recent general election.
“Kindly take note that we expect to receive the said documents in any event within seven days from the date hereof to enable our client to actualize and realize his constitutional right as enshrined in Article 36,38,81 and 87(2) of the Constitution of Kenya. In the event we don’t receive the said documents and/or within the time prescribed above, we shall take further legal action as shall deem fit and appropriate,” reads the letter in part.
Wanga was proclaimed the winner by Homa Bay IEBC returning officer Fredrick Apopa with 244,559 votes to Kidero’s 154,184.
In rendering the results public, Apopa claimed to have followed all proper protocols and to be confident that the outcomes accurately reflected the wishes of the Homa Bay populace.
She succeeds Cyprian Awiti.
“We verified and tallied the results as brought by returning officers from the constituencies and satisfied that they were accurate,” Apopa said.
Kidero claimed that several polling places did not count his ballots because Form 37As were changed in Mfangano, Rusinga, and other wards throughout the county.
According to Kidero, he received more over 225,000 votes and won six out of the eight seats.
“We have evidence how some IEBC officials colluded with agents of my opponent to doctor and messed up with Form 37As. For the avoidance of doubt, we’re going to challenge the outcome in court,” he said.
