A Nairobi court has issued a warrant of arrest against Ndichu brothers after they once again failed to appear in court for their assault case.
Kibera Law Courts ordered the immediate arrest of Paul and Eddie Ndichu charged with assault and malicious damage to properly.
“Since the accused person is not in court despite a court order, I, therefore, issue a warrant of arrest against them,” Kibera Chief Magistrate Ann Mwangi ordered.
The lawyer holding brief in the matter had told the court that the accused persons’ lawyer was in another matter at the High Court.
“I am holding brief in the matter and I have instructions to ask for another date since their lawyer is in another matter at the High Court,” he said.
Last week, the twins were set to appear in court to face the charges of assault and malicious damage to property but they failed to show up.
Eddie tested positive for Covid-19 on March 12, according to their lawyer, while Paul was being held in isolation after showing symptoms of the disease.
“The accused person tested positive on March 12 and is in quarantine together with the second accused person who has shown some symptoms related to Covid. We expect them to finish the quarantine on March 26,” the lawyer told the Kibera court.
The lawyer gave the court Eddie’s Covid-19 certificate as proof.
Eddie failed to enter a plea for the third time after failing to appear on February 8 and March 9.
Paul was charged before Kibera senior resident magistrate Renee Kitagwa. He denied the charges.
He was released on Sh100,000 bond with cash bail of the same amount.
Lawyer Phillip Murgor had told the court in the previous session that the accused person was taking the court for granted after Edward failed to appear in court for plea taking.
