High Court judge Luka Kimaru has ordered the Inspector General of police and the DCI to produce Miguna Miguna in court today at 2pm.
The judge has said the two should comply with the order or appear in court to showcause as to why they should not be cited for contempt or rather be punished for defying court orders.
The DPP’s office said they were having difficulties getting instructions from police.
Lawyer Peter Malinyani told Justice Kimaru that Nairobi DCI boss Ireri Kamwende told them he has no instructions regarding the opposition politician’s release.
Miguna was arrested at his Runda home in Nairobi on Friday following his role in the January 30 Raila Odinga swearing in.
His lawyers on Sunday complained that they were not allowed to access him at Lari police station where he was reportedly held in custody.
