A 30-year-old man, who was apprehended by members of the public after allegedly robbing and raping a 45-year-old woman in Kariobangi, Nairobi, has been charged with the capital offence of robbery with violence contrary to section 296 (2) of the Penal Code.

Appearing before Makadara Chief Magistrate Beatrice Kimemia, Kelvin Otieno Odhiambo was charged with violently robbing MWM of a Sh30, 000 mobile phone and Sh250 in cash at Kanyama area on August 11.

Odhiambo is accused of committing the offence jointly with an accomplice with the prosecution telling the court they used actual violence against MWM during the incident.

They alleged strangled her before Odhiambo’s accomplice escaped with everything they had stolen from the complainant as members of the public came to her rescue.

The suspect was also charged with rape contrary to section 3 (1) (a) of the Sexual Offences Act (SOA) of 2006.

Odhiambo is accused of raping MWM after robbing her and faces an alternative charge of committing an indecent act with an adult.

The suspect denied all the charges and was granted a bond of Sh300,000 without the option of a cash bail.

According to court records, MWM was walking home at around 1am when she saw two men following her from behind.

She took off but they caught up with her and one of them grabbed her by the neck as the other ransacked her handbag which had the phone and cash. One of them was armed with a knife during the incident.

The two stripped her naked after the alleged robbery and then raped her before members of the public gathered and went for her rescue.

Odhiambo’s accomplice escaped but he was not lucky as he was nabbed before being handed over to three police officers on patrol, who escorted him to the local station.

MWM was examined and treated at Medisen San Frontiers (MSF) Hospital.

The three police officers  who arrested Odhiambo are listed as witnesses in the case alongside a medic at MSF.

The case will be mentioned on August 27 before hearing starts on October 10.
