Nairobi lawyer Ally Ahmed charged over alleged Sh49.4million land deal fraud

A Nairobi-based advocate has been charged with allegedly stealing Sh49.4 million entrusted to him to facilitate the purchase of a prime parcel of land in the city.

Ally Ahmed Ahmed appeared before the Milimani Chief Magistrate’s Court on Tuesday, August 4, 2026 where he was charged with stealing by agent, contrary to Section 283(b) of the Penal Code.

The prosecution alleges that Ahmed unlawfully converted Sh49,400,500 entrusted to him by Quba Real Estate Limited for the purchase of a parcel of land identified as Nairobi/Block/42/895.

According to the charge sheet, the alleged offence occurred between November 16, 2023 and January 3, 2024, when Ahmed was acting as an agent of the real estate company.

The money, the prosecution alleges, was placed under the advocate’s control for the specific purpose of completing the land transaction involving property belonging to Julius Macharia Waweru and Eva Muthoni Waweru.

Instead, Ahmed is accused of diverting the funds and converting them to his own use.

The case followed investigations by the Directorate of Criminal Investigations (DCI) after Quba Real Estate Limited reported the alleged loss of the funds.

The DCI said detectives traced and arrested Ahmed in the upmarket Kilimani area on August 3, before he was taken to court the following day.

“Investigations established that the complainant entrusted the suspect with Ksh49,400,500 on diverse dates between 16th November 2023 and 3rd January 2024 to facilitate the purchase of the land,” the DCI said.

The agency said the investigations established that the money was allegedly not used for the intended transaction but was instead diverted and converted to the advocate’s personal use.

Ahmed was subsequently processed and arraigned before the Milimani court, where he took plea to the charge.

Under Section 283(b) of the Penal Code, stealing by agent involves dishonestly taking property entrusted to an individual for safe custody or for a specified purpose, including applying, paying or delivering it to another person.

The offence carries a custodial sentence, with the law providing for imprisonment where an offender is convicted.

The prosecution will be required to prove the allegations against Ahmed in court. He remains presumed innocent unless and until he is found guilty.

The arrest comes days after the DCI announced the arrest of another suspect wanted in connection with a separate multi-million-shilling land fraud case involving the alleged sale of plots in Kajiado County.

The suspect, Nancy Wamuyu Njai, was arrested pursuant to a court warrant and was being processed for arraignment, according to the DCI.
