Man jailed for six months after assaulting wife over alleged infidelity in South B, Nairobi

A man who hit his wife with a padlock before kicking and wrestling her to the ground during a near deadly assault after accusing her of infidelity will remain behind bars for a period of six months.

George Otieno was jailed by Makadara Law Courts Senior Resident Magistrate Wandia Nyamu after he pleaded guilty to charges of assaulting his wife Elizabeth Eshiwani

Otieno injured Eshiwani at their rented house in Hazina village within South B Division in Starehe Sub County, Nairobi on July 20, 2025 and admitted charges of assaulting her contrary to section 251 of the Penal Code.

The court heard that Eshiwani was in the house when her husband returned while having a conversation on phone and she could hear her mother in law on the other end of the phone.

But after the telephone conversation, Otieno descended on his wife with blows and kicks then took a piece of cooking stick and assaulted her before hitting her with a padlock as she fled.

Her neighbours came to her rescue but Otieno threatened them before they all scampered for their safety but Eshiwani managed to escape and sought refuge at South B police station where she made a report after the neighbours distracted her assailant.

Eshiwani returned to the house and found her mother who had gone to check on her, outside the house and Otieno was hurling imprintable expletives at elderly woman.

The complainant collected her belongings from the house and left then proceeded to hospital for medication. Otieno wanted his wife to leave the house immediately before he attacked her.

In mitigation, he said he could still apologise to his wife and sought leniency.

Wandia said the acts of the convict needed a deterrence penalty as they are a threat to women and sentenced the convict to serve the custodial sentence.
