Man charged with obtaining Sh6.6 million in false land sale
A businessman has been charged in a Nairobi court with allegedly obtaining over Ksh 6.6 million from three people by falsely pretending that he was in a position to sell them land in Syokimau.
In the first count, Benjamin Mulwa Muiya was charged that on diverse dates between July 2022 and April 30, 2023 in Nairobi County with intent to defraud obtained Ksh 3 million from Siratho Mohammed Abdi.
The prosecution told the court that the accused pretended that he was in a position to sell his piece of land, registration number 611 in property LR No 345/30 situated in Syokimau.
In the second count, he was charged with obtaining Ksh 1,064,910 from Abdullahi Ahmed Roble by falsely pretending to be in a position to sell him a one acre piece of land plot number 647 in property LR No 345/30.
The court heard that he committed the alleged offence on diverse dates between October 2022 and January 2023 in Nairobi County.
He was further accused of obtaining Ksh 2.6 million from Abdullahi Mohammed Hassan by pretending that he would sell a one-acre piece of land in the same area.
He denied the charges when he appeared before Milimani Principal Magistrate Gilbert Shikwe.
The prosecution led by James Gachoka did not oppose his release on bond but prayed to the court to consider the weighty of the offences.
“Your honour, I do not oppose the release of the accused on bond but I urge this court to give an amount which commensurate the offences committed,” Gachoka said.
His defence lawyer Zack Mwambi, however, prayed for leniency, saying the charges are mere allegations that are not not supported by any document.
“Your honour I urge you not to be coaxed by the amount indicated in the charge sheet and I pray my client be released on lenient bond terms,” Mwambi told the court.
In his brief ruling, the magistrate said that bond is a constitutional right for every person and also noted that the prosecution did not oppose the same.
The accused was freed on bond of Ksh 500,000 with a surety of the same or alternative cash bail of Ksh 200,000 with one contact person.
The matter was scheduled for pre-trial on February 3, 2025.
Separately, a facial therapist at a Nairobi hospital has been charged with threatening to kill.
Duncan Chengo is alleged to have threatened to kill John Maina Wangechi at Kenyatta Market within Kibra sub county in Nairobi county.
He denied the charges and was released on a bond of Ksh 100,000.
