Lawyer Cecil Miller threatens to sue whistleblower Nelson Amenya for defamation over KUSCCO post
Through his lawyers, he is demanding that he immediately tenders an equivocal and unconditional apology to him and publish it on his X account in terms acceptable and approved by their client
Vocal city lawyer Cecil Miller has issued a demand letter against whistleblower Nelson Amenya over article published on his X account regarding the Kenya Union of Savings and Credit Cooperatives (KUSCCO) saga, which he says are defamatory.
Through the law firm of PW Wena & Company Advocates and lawyer Jared Obare, Miller takes issue with the article published by Amenya, a Paris-based student, entrepreneur and commentator on August 12 Amenya in which he claims the lawyer siphoned more that Sh30 million supposedly for representing KUSCCO in “dubious cases.”
Among other Amenya, among others, further questions why the union plans to spend Sh20 million on advertising despite allegedly being Sh12 billion in the red, terming it a “financial comedy.”
Amenya’s article is accompanied by attachments of copies of what he claims is internal KUSSCO correspondence as well as those with Miller & Company Advocates.
Miller’s lawyers, however, want Amenya to pull down the offending article titled “Update: Vipindire at KUSCCO” within 12 hours from his X account or any other social media account failure to which they will file suit against him without further reference and at his risk to costs.
“We demand that you immediately tender an equivocal and unconditional apology to our client and publish the said apology to your X account in terms acceptable and approved by our client, “added Wena.
Miller contends that the article and words, which, he says, were recklessly and maliciously published, have damaged his reputation and caused public ridicule, scandal, odium, suspicion and contempt of him by the members of public.
According to Wena, the words are interpreted by public to mean that his client is dishonest and has siphoned Sh30 million from KUSCCO in the guise of legal fees for work not done or non-existent work.
As a result of the said article, Obare says his client has suffered injury to his reputation and character in the eyes of his peers, professional colleagues and right thinking members of public.
Amenya, who writes a weekly column in a local newspaper but is very active on social media, came to the limelight when he blew the whistle on plans to lease the Jomo Kenyatta International Airport to Indian conglomerate, the Adani Group, forcing President William Ruto to halt it following an outcry.
Some of his claims have, however, attracted court suits from those targeted.
