Eastleigh North OCS, Sergeant ordered to appear in court over torture, abuse of office claims

The Nairobi court has ordered two police officers to appear in court to face charges of torture and abuse of office which is against the law.
Yesterday, Rebecca Njeri Muraya, Officer Commanding Station (OCS) who at the time of the offence was attached at Eastleigh North Police Station and Sergeant Abdisalam Ahmed from the same station failed to appear in court to face charges.
State prosecutor Irene Magolo told the Milimani Chief Magistrate Lucas Onyina that Muraya and Ahmed were supposed to appear in court to face charges but failed with reasons of sickness.
Magolo presented a medical document from Elwak Cottage Nursing Home dated January 21, 2025 indicating that Abdisalam Ahmed is ailing and the doctor directed him to have a bed rest in the process of recovery but added that the report does not show the duration of bed rest.
The prosecutor also prayed the court to defer the plea taking of the suspects and appear in court on the date the court will suggest.
“Your honour I pray this court to defer the plea taking and the court to direct the dates they will both appear to face charges drafted in the charge sheet before the court,” she submitted.
According to the court documents, Muraya and Ahmed being police officers within the National Police Service on December 31, 2021 at the said police station intentionally and unlawfully jointly ordered the arrest of Ayni Hussein Mahammud detained her at Muthaiga Police Station for two days with intent to intimidate her pursuing her complaint of assault against Abdihakim Saidi Jama.
The duo further were expected to face another charge of abuse of office to section 101 (1) as read together with section 102 of the Penal Code.
On December 31, 2021 at Eastleigh North Police Station within Starehe Sub-county in Nairobi county they jointly unlawfully and without any sufficient cause arrested Ayni Hussein Mahammud and detained her in Muthaiga Police Station.
The magistrate directed the matter to be mentioned on February 13, 2025, and directed the suspects to appear in court for direction.
