Court orders State to pay freedom fighter Kubai’s widow Sh500million for land

Environment and Lands Court judge Mwangi Njoroge has ordered the government to compensate the widow of freedom fighter Fred Kubai at least Sh500 million for building a hospital on her land without her consent.

According to documents from the Lands registry, Judge Njoroge ruled that Kubai is the official landowner of the 10-acre land in Naivasha, Nakuru county.

He further stated that the government went ahead to build a public hospital on private land and thus the need to compensate her.

“The government and the Ministry of Health’s action of taking possession of her land amounted to trespass and gross violation of her rights to own property.

They had no right to interfere with her possession of the land without following the right procedure of compulsory acquisition,” ruled Njoroge.

The judge ordered the Attorney-General, Ministry of Health and County Government of Nakuru to initiate the compensation plan, which the judge set at the market value of Sh500 million.

Kubai will get an additional Sh20 million for trespassing on the land and taking over in 1993.
