Busia man handed life imprisonment for incest

The prosecution presented evidence and testimonies from four witnesses, which outlined the details of the crime

A middle-aged man in Busia has been handed a life imprisonment after he was found guilty of committing incest with a 12-year-old minor.

Stephen Owino Nekesa was convicted of the charge under Section 20 of the Sexual Offences Act with the court hearing that he committed the act in August 2023 at Khunyangu village in Butula, Busia County.

“Owino was charged of incest with a 12-year old child under Section 20 (1) of the Sexual Offences Act No. 3 of 2006 for the crime occurred on August 28, 2023, at Khunyangu Village in Butula Sub-County within Busia County,” the Office of the Director of Public Prosecution (ODPP) shared.

The  ODPP added that as an alternative charge, the accused was also charged with committing an indecent act with a child under Section 11 (1) of the Sexual Offences Act.

The prosecution, represented led by Abraham Mumo, presented evidence and testimonies from four witnesses, which outlined the details of the crime.

The evidence revealed that on the night of August 28, 2023, the complainant went to deliver food to her brother, the accused.

Upon her arrival, he stepped outside, grabbed her, and forced her into the house.

He covered her mouth and pushed her into the bedroom, where he sexually assaulted her.

The trial court concluded that the prosecution had proven beyond a reasonable doubt that the accused committed incest, as defined in Section 20 (1) of the Sexual Offences Act.

As a result, he was convicted and sentenced to life imprisonment.
