Blow to Malala as court upholds his removal as UDA supremo
Justice Mwamuye also nullified the proceedings before the Political Parties Dispute Tribunal, confirming that the appeal by the former lawmaker cannot be heard by a tribunal.
The High Court has upheld the removal of the former Kakamega Senator Cleophas Malala as the United Democratic Alliance (UDA) Secretary General.
In his ruling, Justice Bahati Mwamuye quashed the Political Parties Disputes Tribunal (PPDT) decision that had reinstated Malala to the position and barred the Registrar of Political Parties from gazetting his replacement.
“An order is hereby issued quashing the directions and orders made on September last year by the Political Parties Dispute Tribunal and quashing any subsequent orders emanating from and or in furtherance of those proceedings,” Mwamuye ruled.

The former SG was ousted in August last year following a National Executive Committee meeting which had been convened by Embu governor and UDA Chairperson Cecily Mbarire.
Malala was then replaced by East African Legislative Assembly Member Hassan Omar in an acting capacity.
“The National Executive Committee has determined to designate the Vice-Chairperson, Hassan Omar Hassan, to act as the Secretary-General on an interim basis. The appointment of Cleophas Malala as the interim Secretary General is hereby revoked. These changes are effective immediately,” Mbarire announced.
UDA noted that Malala was removed legally and procedurally from the position, and the ouster was a collective decision by the NEC, which had appointed him.
Following the ouster, Malala moved to the PPDT to challenge his removal as the UDA party SG.
In the wake of his ouster, the former SG continued with HIS rebellion as he accused President William Ruto-led part of victimizing him for declining to support the impeachment of former deputy president Rigathi Gachagua.
He accused the Embu governor and the National Assembly Majority Leader, Kikuyu MP Kimani Ichung’wa, of being the mastermind behind his ouster.
