The High Court has dismissed a case challenging the implementation of the Affordable Housing Bill 2023.
In the case, Kisumu-based activist Lawrence Opiuo had challenged the process on grounds that the National Assembly “was unusually and unprecedentedly fast-tracking” the legislation of the Affordable Housing Act, ignoring the required public participation.
However, the court noted that public hearings and consultation with stakeholders and experts concluded on January 30, adding that it will not interfere with the legislative making process.
Justice Mwanaisha Shariff further noted that the National Assembly cannot be faulted for how it has conducted public participation concerning the bill.
“This court finds that the public participation conducted by the national assembly was effective and conditionality compliant,” the court noted.
