Miguna castigates judiciary after dismissal of 4 cases against Matiang’i, Kibicho
Fiery lawyer Miguna Miguna has castigated the judiciary after four cases he filed against former Interior Cabinet Secretary Fred Matiang’i and outgoing Interior Principal Secretary Karanja Kibicho were dismissed.
Miguna also threatened a legal action against a judge who dismissed the cases.
“On whose orders did she dismiss four of my cases against Fred Matiang’i, Kibicho and others on 14 October 2022?” Miguna said through a post on his Twitter handle.
He said the cases were dismissed prior to his arrival to Kenya on October 20, 2022 and was not given any notice on the withdrawal of the case terming the move as illegal.
“Without notice to me instead of rendering judgement against the defendants who hadn’t defended?” Miguna said.
He now says the judge must be investigated for what he termed as “surreptitiously” presiding over multiple cases against state perpetrators of impunity.
The lawyer accused the judge of colluding with state officials without his knowledge.
“I have instructed advocates to reinstate the cases and pursue action against the judge,” he added.
Miguna further claims the judge in question presided over more than one case in one sitting.
He said this is against the rules of the Court and common practice around the world.
In June, Miguna filed a suit against the Interior CS Fred Matiang’i in Canada seeking at least Sh2.8 billion compensation.
The case was presented at the Ontario Court of Justice.
He said the fee will cater for the damages that were caused during his deportation, which include assault, defamation and unlawful detention among others.
