Mombasa tout now wants former Kiambu governor William Kabogo jailed for failing to pay compensation over an accident involving the politician’s vehicle which led to the amputation of his leg.
Joseph Matano, who was knocked down on August 6, 2009 says he sought legal compensation soon after the incident, where former Mombasa Chief Magistrate Julius Nang’ea ordered Kabogo to pay Sh1.8 million which has since accumulated to Sh3.4 million in interests.
The complainant filed an application whose hearing has since been scheduled for November 22 this year.
The court has further informed the former county chief of the hearing and the scheduled date.
“Take notice that the matter has been scheduled for hearing of notice to show cause dated June 11, 2021 on November 22. Take further notice that in default of your attendance, the court will proceed to hear the said suit, your absence notwithstanding at your cost,” the notice to Kabogo reads in part.
In his defence Kabogo alongside his driver identified as Joseph Gitau have since denied culpability and blamed the tout for being careless leading to the accident on that fateful day.
