The High Court yesterday heard that the Director of Criminal Investigations (DCI) issued a warrant of arrest against lawyer Phillip Murgor for allegedly faking the late city tycoon Tob Cohen’s Will.
Murgor, who is the attorney for the late businessman’s widow Sarah Wairimu, asserted that Kinoti did submit a warrant of arrest however, the prosecutor turned down the request during Cohen’s sister Gabriele Van Straten’s cross-examination.
Despite lack of proof that Murgor faked the Will presented to court, the lawyer claimed Straten was the one who wanted him imprisoned.
Straten told the court that she wanted the attorney detained for forging her late brother’s Will.
In order to obtain a warrant of arrest against him, DCI wrote a letter to the DPP on September 10, 2021, which Murgor then read before the court.
“This is a murder case where an innocent person was cruelly murdered in cold blood. The spirit of the innocent soul will haunt anybody who may interfere with justice in bringing to book any person who was involved in the heinous act,” the letter by DCI said.
After Murgor refused to comply with the summons to appear before DCI officials for an interview on the disputed will, which is believed to be a forgery, DCI sought the issuance of an arrest warrant for him.
The status requested by the suspect counsel will not only undermine the ongoing murder investigation but will also cause it to collapse entirely, according to DCI’s letter, unless the aforementioned Will was forensically confirmed to be real or manufactured.
