Nakuru High Court has directed Inspector General of Police Joseph Boinett to arrest Nyandarua County Commissioner Samuel Kimiti for contempt of court or face action.
Justice Stephen Radido said the police boss has until Friday to ensure compliance of a warrant of arrest issued by the court on November 17, 2016.
The County Commissioner is alleged to have illegally sacked Kipipiri Location Chief Lucy Wangari when he chaired a committee which heard a disciplinary case against her.
In a letter dated September 6, 2016, Wangari was interdicted by the county commissioner on allegations of gross misconduct in her office as a chief.
She was accused of perpetrating hate speech on social media and engaging in politics while being a civil servant against the law.
Despite the court reinstating her on October 26 last year, she is yet to report to her work station.
Wangari’s lawyer Stanley Kihiko told the court that it was unfair that his client’s salary has been withheld and the office of the Inspector General is reluctant to execute the order.
“The IG’s office is not willing to execute the arrest of the county commissioner and my client is not receiving her salaries this is after the court of appeal threw out their application to block the arrest,” said Kihiko.
In his application before court, Kihiko urged the court to summon the Inspector General of Police to explain why his office has failed to obey a court order to execute an arrest warrant of the county boss.
However his application was denied by the court when Justice Radido extended the warrant for three days to allow the police to make the arrest.
