TSC interdicts two teachers over student assault in Siaya County

The Teachers Service Commission (TSC) has interdicted two teachers accused of assaulting a primary school pupil in Siaya county over poor grades.

Yesterday, through their lawyers Edwin Ooro, Paul Otieno Osogo and Maurine Awuor Otieno TSC presented the interdiction letters at Siaya Law Courts during the hearing of the bond application.

“This objection (to bond) is a waste of precious judicial time and nonsense,” Ooro said.

On July 19, 2022, the duo was accused of inflicting corporal punishment on the student.

The student had received 346 points, which his educators were allegedly unhappy with, instead insisting that he receive at least 400 points.

However, the prosecution, led by counsel Tracy Nambisia, objected to the bond motion due to concerns about witness influence.

Nambisia and investigating officer Pauline Wekesa both stated that the teachers could intimidate minor witnesses.

“The accused can still find and intimidate the children and cause them not to attend court because they know them very well,” Nambisia said.

The minor’s father had previously written to the court, requesting that the case be dismissed.

Justice Lester Simiyu asked the investigators to draft an affidavit and copy all parties involved.

However, Ooro wanted the affidavit thrown out due to technicalities.

He observed that the affidavit had not been signed by the investigating officer and had been stamped by an Advocate and Commissioner of Oaths, William Wekesa Lusweti who was far away in Nairobi.

However, the investigating officer, Wekesa, claimed ownership of the document, claiming that she did not have enough time to sign it.

Osogo and Otieno were remanded for two more days, pending the outcome of their bond application tomorrow at 9.30 a.m.
