The prime suspect in the mysterious killing of his elder brother James Nymbane, the Kapsoya ward MCA Kanu candidate’s three kids appeared in an Eldoret court today but was not allowed to take plea in connection with the alleged crime.
This was after the Deputy Director of Public Prosecution in charge of North Rift region Zachary Omwenga sougt for ten more days to complete the investigations into the matter which he termed as complex.
Omwenga told Senior Resident Magistrate Charles Obulutsa that they require more time to comb through all avenues to bring to book perpetrators of the heinous act. The 26 year old Enock Onsare who is the key suspect in the killing of the children looked composed throughout in the dock as the Deputy Director of Public Prosecution argued his case.
He argued that initially the suspect who was the last person to be seen with the children on the material day they went missing was to be charged with charges related with abduction. The DPP told the court that since the innocent children’s bodies were found flooding in River Nzoia in TransNzoia County later on, the circumstance of the case changed to murder case.
He said that more officers from directorate of criminal investigation in Nairobi had been posted to the Eldoret to assist the officers on the ground in piecing together evidence that would sustain murder charge against the suspect and his accomplice who are still at large.
Omwenga said the investigations will is already under way will focus the Kapsoya home of the victims and Trans Nzoia County where their bodies were found flooding in a river after they went missing.
“Your honour, there is probability that the suspect could not have committed the crime alone and that is why we need more time to carry out inept investigation to apprehend his accomplice in the killing of the three boys aged between 6, 5 and 3 years.
However, the magistrate accepted the application by Omwenga and ruled that the case will come up for further direction on June 6th. “ I have no object to the application filed by the DPP to be given more time to complete investigations into the matter and I direct that all parties appear before this court on June 6 for further direction on the case,” ruled Obulutsa.
