The opposition today maintained that presidential election results announced at the constituency level are final to avoid rigging at the national level.
However, the decision on whether the Independent Electoral and Boundaries Commission (IEBC) Chairman, Wafula Chebukati, holds the final say in the presidential race will be determined by a five-Judge appellate bench on June 23.
The Coalition for Reforms and Democracy (Cord) insisted that Chebukati should not be exclusively mandated to oversee the presidential election and declare the winner.
The IEBC had recruited competent returning and presiding officers responsible for the polls in 290 constituencies countrywide and an individual cannot purport to change the will of the citizenry, the opposition argued before the Court of Appeal.
