Man initially sentenced to death on verge of gaining freedom

A 40-year-old man, initially sentenced to death after being found guilty of robbery with violence, is on the verge of being released from prison to 20 years imprisonment after he appealed against it.
Dennis Macharia Muriuki was convicted on November 12, 2012 and sentenced to death by a Nyeri court but it was later commuted to a life sentence by the president on the recommendation of the Power of Mercy.
However, a remorseful Muriuki proceeded to appeal seeking to have reviewed, stating that he has undergone rehabilitation during his stay in prison.
He was charged with stealing a DVD machine make LG, two mobile phones make, Nokia and Samsung, a remote, a Samsung battery and cash of Ksh 9,200.
During the robbery, Macharia and his accomplices threatened to use violence but they did not use the actual violence.
In considering the submissions by the appellant, Nyeri High Court Judge Kizito Magare stated: “I shall substitute the life sentence with it’s equivalent, that is 20 years. In accordance with Section 333 (2) of the Penal Code the sentence will run from from the date of arrest that is July 14, 2011.”
