LSK sue Supreme Court over move to ban lawwyer Ahmednasir Abdullahi, associates from court

The Law Society of Kenya (LSK) has sued the Supreme Court over the decision it made against Senior Counsel Ahmednasir Abdullahi.

The lawyers’ body said the decision to bar Ahmednasir together with employees of his law firm from appearing before the court is unconstitutional and unreasonable.

In the case filed under a certificate of urgency, LSK argues that Ahmednasir together with his employees were never given an opportunity to be heard.

“It failed to consider other avenues of redress that were available.” The petition reads in part.

LSK further argues that the court did not consider the harm that would be caused to the lawyer and his employees as well as his clients.

“A democratic country requires pluralism, tolerance and broadminded which respectfully, the Supreme Court has failed to exercise,” reads court papers.

The lawyers’ body also argues that in 1990 and early 2000s, at a time when corruption and incompetence were again said to be rife within the Judiciary, it was Ahmednasir who almost singlehandedly took onto the task of naming and shaming the judges, resulting in the dismissal of 23 judges.

LSK now wants the decision made by the judges quashed.

This comes after the Supreme Court made good its communiqué by declining to hear lawyer Ahmednasir.

Ahmednasir had appeared before the court to represent a family in a legal battle over a Sh2billion land case with the family of the late retired President Daniel Moi.

During the virtual hearing, the judges led by Chief Justice Martha Koome said they would not proceed with the matter if Ahmednasir was part of the defense team, or if any gadget belonging to the lawyer followed the proceedings.
