Four directors of Wendano Matuu Company Limited charged with forgery
Four directors of Machakos county based land buying company, Wendano Matuu Company Limited involved in a leadership wrangle for the last 10 years have been charged with falsefying company records which they found at the Kangundo and Machakos High Courts Land divisions.
Onesmus Muisyo, Benedict Mutuku, Harrison Muya and Christopher Nzimba appeared in court while the fifth director Stephen Muli failed to appear before Milimani Principal Magistrate Gilbert Shikwe to answer 20 counts of forgery.
The five are charged with forging minutes of a special General Meeting of Wendano Matuu Company Limited with an intention to deceive.

They denied forging the said minutes on February 14, 2020 at an unknown place within the republic of Kenya.
The fourth allegedly forged signatures of members Peter Kaseva, Boniface Maweu, Nelson Nzomo, Richard Mbalu, Kivuu Mulwa, Naomi Kavee and Ndumi Maweu which they presented at the Kangundo Law Courts without their authority.
They are also charged with falsefying records from the law farm of Howard Nick and Howard Advocates which were used as evidence at the Kangundo and Machakos High Courts.
Through their lawyer, they applied to be released on reasonable bonds saying they are advanced in age and therefore not a flight risk,
“The accused persons before you are senior citizens aging between 61 and 81 years old and cannot abscond.” A defence lawyer told the court.
The court was urged to release them on a free bond as the case is about leadership wrangles and no money has been lost.
The magistrate heard that the present matter stems from other litigations pending at the Kangundo and Machakos High Courts,
“The case before court is purely a leadership wrangle that has been pending in court since 2014 therefore the issues in question are subject pending determination In other courts.” The defence lawyer submitted.
The magistrate heard that the Machakos High Court matter is lifted for judgement which will be delivered on February 27, 2025.
State prosecutor Judy Koech did not oppose their release on bond but applied for a warrant of arrest against Stephen Muli who did not appear in court saying he was on the run and has been ignoring police sermons.
To the contrary the defence lawyer said that Muli has never been sermoned to appear in court or to the DCI Machakos or Nairobi.
The lawyer said that Muli is within the reach of the court and will be presented in court on December 17, this year for plea taking.
In his ruling the magistrate noted that the accused persons are elderly aging between 61and 81 and has demonstrated their active proceedings pending in other superior courts.
He directed each of the accused persons to deposit a cash bail of Sh100,000 pending pre-bail directions on January 20, 2025.
The magistrate further issued sermons to Muli to appear before court next week for plea taking.
