CJ Martha Koome champions for Alternative Dispute Resolution
The Judiciary is seeking to have Kenyans embrace the different forms of Alternative Dispute Resolution in a move to decongest and ease the back log at courts.
The alternative systems are designed to see Kenyans get access to justice without involving going through a tiresome process while addressing social grievances.
Speaking virtually at the Chartered Institute of Arbitrators (CIArb) Kenya Branch International Conference, Chief Justice Martha Koome said that so as the Judiciary to access justice through various forms of Alternative Dispute Resolution, it will partner with key stakeholder to ensure that every Kenyan has access to justice.
The Judiciary in accordance to the constitution has been pushing for alternative forms of dispute resolution mechanisms to enhance delivery of justice to all its citizens.
The CJ termed the talk timely, following the need for the resolution systems to be emphatic on people-centred justice and Alternative Dispute Resolution is one of the avenue for improving access to justice.
The system has been viewed as advantageous because it decongests courts’ caseloads and respects the wishes of parties.
Further, in commercial matters where these processes are involved, Kenya becomes a more attractive investment destination if court processes are the last resort.
