The High Court will handle the petition challenging the academic qualifications of Narok gubernatorial candidate Patrick Ole Ntutu on June 7.
An aggrieved voter, Patu Ole Makumi, is required to provide the court documents to all the parties involved within seven days to enable them to file their responses.
The complainant has sued the Commission for University Education (CUE), the Kenya National Examinations Council (Knec) and the Independent Electoral and Boundaries Commission (IBC).
Justice John Mativo declined to make any temporary orders in the petition in which the voter wants the Narok West Member of Parliament barred from participating in the race to unseat Governor Samuel Tunai.
The petitioner claims Ole Ntutu does not qualify to vie for the gubernatorial seat on the basis that he does not meet the minimum educational standards of a university degree.
He said Ole Ntutu has already secured nomination from Chama Cha Mashinani and the political rights of voters would be prejudiced by his candidature. “It will be unjust if the aspirant is allowed to participate in campaigning and elections when his academic qualifications have been questioned,” he says in court papers.
The complainant said he had tried unsuccessfully to obtain information from CUE and Knec to ascertain Ole Ntutu’s academic credentials.
