Businessman charged over alleged fake documents in multi-million share transfer row

A businessman has been charged before the Milimani Law Courts with 12 counts of making and uttering allegedly false documents linked to changes in the ownership and directorship of Channa Investments Limited.

Mandeep Singh Channa, who was arrested on September 24, 2026, pleaded not guilty to all the charges and was released on a Sh300,000 cash bail.

The prosecution alleges that Channa and others not before the court created and used documents purporting to effect the resignation of Supinderpaul Singh as a director of the company and later facilitate the transfer of 4,000 ordinary shares from Singh to Channa.

The charges have been brought under Sections 347(a), 349 and 353 of the Penal Code.

According to the charge sheet, the alleged scheme involved affidavits, board minutes, a resignation letter and share-transfer documents that were subsequently submitted through the Business Registration Service (BRS) system using Channa’s eCitizen account.

In the first count, Channa is accused of making a false affidavit dated October 19, 2022, purporting it to have been sworn by Supinderpaul Singh before Esther Asati, an advocate and Commissioner for Oaths.

Prosecutors allege that Channa knew the affidavit was false but nevertheless caused it to be used as a genuine document.

He faces a separate charge of allegedly uttering the affidavit on October 25, 2022, by submitting it through the BRS system to support the purported resignation of Singh as a director.

The prosecution further alleges that Channa made false minutes of a purported Channa Investments Limited board meeting dated October 19, 2022, presenting them as genuine minutes of a duly convened meeting.

He is accused of subsequently submitting the minutes through the BRS system in support of the director’s alleged resignation.

Another pair of charges concerns a resignation letter dated October 19, 2022, which prosecutors allege was falsely made to appear as though it had been duly executed and signed by Supinderpaul Singh.

The letter was allegedly submitted through Channa’s eCitizen account on October 25, 2022.

The case then moves to the alleged transfer of 4,000 ordinary shares in the company.

According to the charge sheet, Channa allegedly made a false share-transfer document dated July 3, 2023, purporting to show that the shares had been transferred from Supinderpaul Singh to him.

He is accused of uttering the document on July 25, 2023, by submitting it through the BRS system in support of the disputed transfer.

Prosecutors also accuse him of making a second allegedly false affidavit dated July 25, 2023, purportedly sworn by Singh before the same Commissioner for Oaths.

The affidavit was allegedly submitted through the BRS system to support the transfer of the 4,000 shares.

The final charges relate to minutes of another purported company board meeting dated July 3, 2023.

The prosecution alleges that the minutes were falsely created to represent that a properly convened board meeting had taken place and were subsequently used to support the share transfer.
