Attorney General Kihara Kariuki has maintained that the delegated meeting between the National Security Advisory Council (NSAC) and the electoral agency chair, Wafula Chebukati before presidential results announcement was strictly security matters.
Appearing for the AG, George Oraro defended the August 15 meeting stating that they had previously met with Chebukati and thus nothing unusual with the said meeting.
“The visit to the IEBC tallying centre was instigated as a result of the activities which had gone on 13th and 14th of August when there was suspension of transmission and displaying of the results,” he submitted.
Oraro regretted that accusing NSAC officials of wanting to undermine the will of the people had harmed their reputation and urged the court to dismiss the accusations.
“I would wish to declare that the Attorney General is completely neutral on the dispute before this court, however, he wishes to address two issues; including grave allegations against some members of the NSAC by the IEBC Chairman,” he said.
Chebukati further stated that NSAC members requested a runoff if he could not proclaim Raila Odinga the outright victor of the 2022 presidential election due to security concerns.
The IEBC Chairman stated that the message was communicated by Kihara, who warned that if he declared William Ruto as president-elect, ‘the country will burn.’
Chebukati claimed in his affidavit that the NSAC, led by Kihara, Kennedy Ogeto (Solicitor General), Inspector General of Police Hillary Mutyambai, and Lieutenant General Francis Omondi Ogolla (Vice Chief of Defence Forces), warned him against announcing Ruto as President-elect because it would have thrown the country into chaos.
