AG, IG Mutyambai to appear in court over disappearance of Bwire, lawyer Nandwa

The Inspector General of Police Hillary Mutyambai and the Attorney General Kihara Kariuki are expected to appear in court today over the disappearance of lawyer Professor Hassan Nandwa and his client; ex-terror convict Elgiva Bwire.

Justice Anthony Mrima of the Constitutional Court issued the orders at Milimani Law Courts on Monday after the two failed to submit their responses in the matter.

“I hereby order that the Attorney General and the Inspector General of Police appear in person in open court on November 11, 2021 at 2.00pm in order to confirm their respective positions in this matter, ” Justice Mrima ordered.

Nandwa who mysteriously went missing last week was yesterday found abandoned in Mwingi, Kitui County, from where he dragged himself to seek assistance.

Family members and officials said Nandwa was found alive but shaken at around 1am.

However, his client, convicted terror suspect Bwire is still missing.

His was found after the High Court had ordered the police to produce him and his client Bwire within 24 hours.

“I have considered the submission made and I’m satisfied there is reasonable circumstantial evidence pointing out the high possibility that the second and third persons are likely in custody or at least they (police) are aware of their whereabouts,” stated Justice Mrima.

Justice Mrima also ordered Safaricom to produce Nandwa’s call logs from the day he went missing.

This was after the Law Society of Kenya (LSK) filed an application against the IG of, the Director of Public prosecutor, the AG and the telecommunications company.

However, the police denied knowledge of Nandwa’s whereabouts.

“It is unfortunate that Nandwa is a victim of crime. Police are doing all they can to trace him and reunite him with his family without harm,” Police spokesman Bruno Shioso said.
