Man who attempted to kill Ranalo foods owner sentenced to 23 years in jail

Tom Oywa Mboya, a businessman accused of attempting to kill Ronalo Foods restaurant owner William Osewe, has been sentenced to 23 years in jail.

Milimani chief magistrate Martha Mutuku sentenced Mboya to 20 years in jail by a for attempting to kill Osewe by shooting him over a woman in 2016.

Magistrate Mutuku also handed Mboya another 3 years for the offence of wounding a security guard Wilfred Ombunya Tembula.

“I sentence the accused to 20 years in jail for the attempted murder charge and three years for wounding him,” she ruled.

This comes after Mboya was found guilty of the offence.

The magistrate noted that the offence of attempted murder is usually committed when there is an intention to kill.

“I have considered the evidence before the court and it is not in dispute that Mboya shot Osewe. He did so not once but four times. I dismiss the defence as the prosecution has proved count number one and found him guilty of the offence under Section 215 of the CPC,” she ruled.

Mboya was accused of shooting Osewe following a fight over a woman at Garden Estate in Kasarani.

In December 2016, Mboya testified that he was on Garden Estate when Osewe came shouting that he was going to kill him.

He said that he shot once at Osewe’s hand and shot again twice in the air.

Osewe was admitted at the Aga Khan Hospital’s High Dependency Unit (HDU) where he underwent surgeries to remove the bullets.

Mboya surrendered himself to Kasarani Police Station and admitted shooting the restaurateur in self-defence.
