A member of Migori County Assembly was today jailed for 15 years by a local high court which found him guilty of defiling a school girl.
Justice Anthony Murima ruled that Ntimaru East Ward MCA Luka Masa Hura be confined in prison for the entire period as he upheld the lower Court’s judgment.
Masa had been convicted and handed the long imprisonment by Rongo Senior Resident Magistrate Purity Rugut in 2015 but appealed.
Immediately after the Judge issued the verdict today, the embattled MCA was whisked, amid tight security to Migori GK prison where he was to start serving his sentence.
However, Justice Murima reminded him of 14 days within which he could appeal against the sentence at Kisumu Appellate court.
Hura who was elected on an ODM party ticket was accused of defiling a 13-year-old standard six pupil in May 2014 within Ntimaru Township in Kuria East Sub County.
Details of the charges stated that he had lured the minor into lodging within the town where he sexually assaulted her.
The minor had narrated to the Rongo court how the accused led her into the lodging and repeatedly defiled her without her consent.
However, Hura had vehemently denied the claims, saying he was framed up by his political opponents.
However, while sentencing him then the Senior Resident Magistrate said the prosecution had proved beyond reasonable doubt that Hura had committed the offence and deserved to be punished severely.
The magistrate had also fined the MCA Sh10, 000 or three months imprisonment in default, after she found him guilty of escaping from the police custody immediately after he was arrested for assaulting the minor.
