A police officer, two private security guards and a housekeeper were yesterday charged before a Nairobi court with failure to prevent a robbery incident at businessman Manu Chandaria’s home on December 14.
The suspects: An Administration Police officer Jared Omboga, two private guards Judah Wafula, Stephen Omwega and housekeeper Jackson Nalondo appeared before Milimani chief Magistrate Martha Mutuku and denied the charges.
The business man was robbed of Sh700,000 and two pearl necklaces valued at Sh1.7 Million. The prosecution wanted to be given until Wednesday to file an application seeking to oppose their release on bail.
But the defence opposed the request terming it an abuse of the court process as the suspects have been in custody since Wednesday last week.
Yesterday morning, the court had released the four on a personal bond of Sh200,000 on condition that they report to the investigating officer every day until December 28.
However, when they went to pick their personal items at the Muthaiga police station, they were re-arrested and arraigned at Milimani law courts .
“The acts of the state are malicious and an abuse of the court process as they have denied them personal liberty and have violated their fundamental rights,” said their lawyer.
Mutuku, however, directed the Director of Public Prosecutions to file their affidavit seeking to oppose bail by today 9am before the hearing at 10am.
