Senior Directorate of Criminal Investigations (DCI) officers have now denounced claims that helped to crystalise ugly turf wars between the Director of Public Prosecutions (DPP) Noordin Haji and former DCI boss George Kinoti.
Through a correspondence signed by immediate former head of Investigations Bureau at DCI headquarters John Gachomo, he has now denied allegations attributed to an affidavit allegedly filed by the office of the Attorney General claiming that he was coerced to sign a form implicating a judge of the Court of Appeal, Justice Sankale Ole Kantai in the murder of Dutch businessman Tobb Cohen.
“Please provide me with a complete copy of the affidavit to enable me understand what has been filed in my name. I have no personal knowledge of what is alleged in the media. I hope that you will not be surprised by my direct communication with you in this matter. The matter is legal and touches me personally.” The letter dated October November 2021 and addressed to Solicitor General Kennedy Ogeto reads in part.
Also in an affidavit, outgoing head of Anti-Terror Police Unit Unit (ATPU) Martin Otieno has withdrawn most claims where he had accused the DPP of using unusual means to develop guidelines, ignoring reservations of DCI and forging entries to imply DCI participated in a donor funded workshop to develop the guidelines.
He had claimed that the lead consultant invited by the Office of the Director of Public Prosecutions (ODPP) was unqualified and that the consultant’s ethnicity, religion was the same as Haji’s since they both shared a united bias as a result of sharing religious beliefs.
“I wish to recant every paragraph that is offensive and discriminatory to the religious and cultural beliefs of Haji and the consultant as it is offensive and not at par with the spirit of the Constitution,” he stated.
He agrees that the DCI is under the control and command of IG contrary to his earlier statements that he was only answerable to the President.
He says that he was not aware of the consultant’s qualifications and he withdrew claims that he was unqualified.
