The court has dropped the attempted rape against nominated Agriculture Cabinet Secretary nominee Mithika Linturi after the complainant, a 36 years old woman who had accused him of attempted rape withdrew the case.
Chief Magistrate Susan Shitubi dropped the charges under Section 40 of the Sexual Offenses Act after the court was informed that an out-of-court had been reached.
Muthomi Thiankolu, Linturi’s lawyer told the court that the woman had sworn an affidavit on September 21 confirming that they had discussed and agreed to withdraw the case.
State Counsel Nyakira Kibera confirmed to the court that the woman had agreed to withdraw the complaint and the proceedings against Linturi.
She confirmed that the DPP was aware of the affidavit sworn by the complainant.
The complainant was present in court and confirmed that there was an agreement between her and Linturi.
The court examined her on oath and she said she voluntarily agreed to withdraw the case and had no intentions of raising it in the future.
The court directed that the Sh200,000 that Linturi had paid as bail be released to him and also the Sh200,000 taken from him by police as exhibit.
