The Supreme Court is set to deliver its ruling on Building Bridges Initiative (BBI) petition on Thursday, this week.
Through a notice, Supreme Court Registrar Letizia Wachira says parties should appear in court at 9.00 am.
“Take notice that the judgment in this matter will be delivered on Thursday, March 31, 2022 at 9.00am before Supreme Court of Kenya,” read the notice.
The BBI appeal hearing at the Supreme Court started on January 18 and ended on January 20, this year.
This is after both the High Court and the Court of Appeal shot down the push to amend the Constitution through the BBI, describing the Constitution (Amendment) Bill, 2021, null and void.
The matter was heard across three days by all the seven Supreme Court judges.
The seven judges are Justices Martha Koome (CJ), Philomena Mwilu (DCJ), Smokin Wanjala, Njoki Ndungu, Ibrahim Mohammed, Isaac Lenaola and William Ouko.
The Supreme Court judges then set January 18, 19, and 20 as dates for the hearings where parties presented and argued their cases, following an appeal by the Attorney General.
In his appeal, Attorney General Paul Kihara challenged key findings of the lower courts that overturned the bid to amend the Constitution including asking the apex court to overturn that decision and declare that the Constitution of Kenya (Amendment) Bill 2021 complied with all requirements to warrant a referendum.
He was also aggrieved that the Appellate court affirmed that the Constitution of Kenya can only be amended when there is civic education, public participation and engagement of the county assemblies before a referendum.
The AG was also aggrieved with the finding that President Uhuru Kenyatta can be sued while in office.
