High Court has refused to grant request of the Ndichu brothers to have their prosecution stopped and the media barred from covering proceedings of their case.
They requested court to bar the media since it had been biased in their reporting and had already convicted them by labelling them in the public court.
“The applicants were not and have not been accorded an opportunity for an explanation on the reasons behind the actions taken by the DPP for the constant harassment, arbitrary arrests and the malicious prosecution,” reads court papers.
High Court judge Hedwig Ongudi ruled that the matter shall be mentioned on March 28.
More details on how the case shall proceed will be laid down during the mention.
The two brothers were to take plea today, however, one twin Paul Ndichu took the plea and denied the charges.
His brother Edward said he was not permitted to be absent at work.
Paul was released on a cash bail of Sh100,000 with an alternative bond of Sh100,000 or a surety of a similar amount.
