High Court summon IGP Kanja, DCI Amin and Interior CS Murkomen over missing abductees, cite them for contempt
Meanwhile, High Court judges Bahati Mwamuye, Diana Kavedza and Alexander Muteti have summoned the Inspector General of Police Douglas Kanja, the DCI Director Amin Mohamed and the Interior Cabinet Secretary Kipchumba Murkomen to appear in court on January 8, 2025 to explain why they defied court orders.
The three judges in separate rulings had directed six abductees be freed from illegal detentions.
While summoning Kanja to attend court in person, Justice Mwamuye said that: “It will not be business as usual since the matter in court involves lives of six Kenyans who were abducted over 10 days ago by persons believed to be police officers.” Justice Namuye ruled.
The judge said he requires a detailed and convincing explanation by the top security bosses and the Interior and National Administration Cabinet Secretary Murkomen as to why they blatantly and arrogantly defied the court’s orders to release the six abductees.
The judge added that the IG and other seven government officers who were served with court orders to release the abductees are in contempt,
“The petitioners do not need to file contempt proceedings as indicated by LSK the court observes the senior government officers are already guilty of contempt.” Justice Mwamuye ruled.
Defence counsel Martha Karua, Kalonzo Musyoka, Kavata Mwaura for LSK and Felix Keaton asked the court to stamp its authority against senior government officers who defied the court orders with impunity.
Karua urged the court not to entertain any explanation from the IG regarding the whereabouts of the six abductees since as the top most security agent he knows everything.
In an emotional court session, at some point, while making his submissions, Gerald Karicha Mwangi, father to missing Billy Mwangi broke down and wailed uncontrollably in court after failing to see his son in court.
“I traveled all the way from Embu after media reports that his son Billy Mwangi and five others would be produced in court.” Karicha lamented.
