The High court on Tuesday upheld the election of Langata MP Nixon Korir and ordered the petitioner to pay Sh5 million in costs.
Justice Lucy Njuguna said the evidence presented by the petitioner was inadequate to justify a nullification of the election.
Njuguna ordered Oscar Omoke to pay Sh2.5 million to Korir while another Sh2.5 million will be paid to the IEBC.
“The petitioner failed to prove his allegations of election irregularities ranging from intimidation of his agents, misuse of public resources and alterations in forms 35A,” Justice Njuguna ruled.
Her ruling follows an order for a vote recount on January 23 to determine the valid and spoilt votes.
