The high court has dismissed a case filed by University of Embu Chancellor Prof Wambua Musili seeking to stop his alleged arrest and prosecution over issuance of postdated cheques worth Sh20 million.
The chancellor through his law firm, Professor Musili Wambua and Company Advocates had filed an application at the High Court on December 19 2016 seeking to restrain Cyrus Maina and company advocates and businessman Kennedy Ngumbao from seeking his arrest and prosecution.
He claimed that the two want him prosecuted for giving out bouncing cheques of sh 10 million and the accrued interest.
The application was however dismissed by Justice Fred Ochieng.
In the suit, Musili says he acted as a guarantor to one of his clients, Explorer Holdings International Limited, who obtained a loan of Sh10 million from businessman Kennedy Mulwa who was being represented by Cyrus Maina and Company Advocates.
However, his client and Mulwa met mutually and agreed that the former would issue its own cheques amounting to Sh12.3 million to the latter.
