Wahome yet to know fate on rally driver Asad Khan murder probe as DPP yet to make decision
Suspect in the murder of Rally driver Asad Khan will wait longer to know her fate on the case as the Director of Public Prosecutions (DPP) Noordin Haji is yet to make a decision on the file forwarded to him.
The Investigating Officer (IO) today told the court that investigations into the matter are complete and the file is before the DPP for recommendation.
In the case, Maxine Wahome was arraigned under a miscellaneous application and has never been charged with any offence.
The prosecutor had applied to have the miscellaneous application closed as they await directions from the DPP.
However, Asad Khan’s family lawyer Danstan Omari objected the move.
Omari said that the IO has not disclosed its recommendations, arguing that closing the miscellaneous application without charging anyone is a set up.
“The investigations officer has not disclosed the recommendations… if the DPP decides to charge the person what happens… this is the first case where we don’t have the directions,” the court heard.
Meanwhile, a lawyer representing the landlord of the premise where the incident happened asked for access to the house, saying that he is suffering a loss of income.
“As of now we have arrears of Sh269,500…it’s our request that the IO gives back the premises to the landlord so that he does not continue to suffer loss of income, given the admission that the investigations are done,” the court was told.
The IO however said that the keys will be released to the landlord once the DPP gives directions on the matter.
The next hearing will be held on February 15,2023 when a ruling will be delivered.
