Two Dusit D2 hotel terror attack suspects put on their defence

The two, who have pleaded not guilty, were charged alongside Abdullahi Ali who entered into a plea bargain agreement negotiated by Chacha Mwita, the defence counsel.

A court has ruled that two men linked to the Dusit D2 hotel terrorist attack on January 15, 2019 have a case to answer.

In a ruling delivered virtually today by Lady Justice Diana Kavedza noted that the two suspects, Hussein Mohammed Abdile and Mohamed Abdi Ali were arrested alongside Mire Abdullahi Ali following investigations into the terror incident that claimed the lives of 21 people, and injured several others.

Abdullahi was thereafter convicted following a plea bargain.

“Having considered the evidence of 55 witnesses, including expert testimonies, and the material presented before me, I am satisfied that the prosecution has established a prima facie case against the two accused persons. I hereby place the second accused, Hussein Mohamed Abdile, and the third accused, Mohamed Abdi Ali, on their defence,” ruled Justice Kavedza.

The prosecution, represented by Duncan Ondimu, welcomed the decision.

Justice Kavedza set hearing set for February 5 and 6, 2025, during which the defence will have the opportunity to present their case by producing witnesses at the Kahawa Law Court.

The two, who have pleaded not guilty, had been charged alongside Ali who entered into a plea bargain agreement negotiated by Chacha Mwita, the defence counsel.

He voluntarily pleaded guilty to the offence of Cyber-Terrorism contrary to Section 33 of the Computer Misuse and Cybercrimes Act, 2018, the offence of Forgery and that of illegally obtaining Kenya Identity documents and was sentenced to serve four years imprisonment.
