Five suspects in Willie Kimani murder have case to answer, court rules

Five accused persons in Willie Kimani murder case have a case to answer after a Nairobi court has ruled that the prosecution has established a case against the five.
The five, Fredrick Leliman, Stephen Cheburet, Sylvia Wanjiku, Leonard Mwangi and Peter Ngugi were charged with the murder of Kimani, his client Josephat Mwenda and driver Joseph Muiruri.
The five were placed on their defense before Lady Justice Jessie Lessit and are expected to present their witnesses before a final verdict is delivered.
“I have considered the entire evidence and having done so I have come to the conclusion that the prosecution has established a prima facie case,” ruled Justice Lesit.
On June 23, 2016, Kimani, Mwenda and Muiruri were abducted shortly after leaving Mavoko Law Courts, Athi River, where they were pursuing a case against the police.
The three were reportedly killed in a thicket in Mlolongo, in a Nissan Wingroad belonging to a police officer then their bodies were stuffed into gunny bags and dumped at Ol-Donyo Sabuk River, almost 70 kilometres away from the crime scene.
Last week, the prosecution formally closed its case in the Kimani murder case after calling a total of 46 witnesses.
Lawyer Cliff Ombeta representing the first accused wants the court to issue summons to OCS Makindu and OCS Mlolongo to provide the OB for June 24 2016.
The defense hearing will start on Monday next week.
