Suspect implicated in land fraud case charged before Milimani law court

A suspect believed to be the mastermind of giving forged land lease documents to unsuspected land owners in the country has been charged at Milimani law court.

The court heard that on an unknown date in October jointly with another already in court conspired to defraud Twalib Musa Obuya Sh 553,550 by falsely pretending that he was in a position to secure two certificates of lease for two parcels of land in Nairobi Block 50/187 and 50/188 at the state department of Lands and Physical Planning Nairobi which was a false fact.

The court heard that he made the two false certificates of lease bearing the names of Twalib Musa with intention to defraud him.

He faced with other charges of forgery contrary to section 313 of the Penal Code.

The prosecution told the court that on about November 13, 2024, at an unknown place within the republic of Kenya forged the signature of Berita Choka a land registrar in Nairobi Registry in certificate of lease number Nairobi Block 50/187 purporting it to be genuine and valid certificate of lease duly signed and issued by the said Berita which was a false fact.

With intent to defraud, he also forged the name stamp impression of Berita Choka in a certificate of lease number Nairobi Block 50/188.

The prosecution prayed the court to deny the accused bond stating that they fear he is likely to abscond and continue committing other offences.

Through the affidavit by the Investigating officer, the prosecutor highlighted that the accused person is a flight risk and his place of abode is unknown,

“Your honour the accused person is a flight risk and his place of abode is unknown.” The prosecutor told the court.

She also told the court that the accused person has another similar matter in the same court and it has a mention date on February next year.

The defence lawyer Collins Mbanda vehemently opposed the plea by the prosecution to deny the accused bond citing that it is his constitutional right unless there are compelling reasons,

“Your honour there are no compelling reasons to deny the accused person his right to liberty.” Mbada said.

The lawyer further told the court that the accused has another same criminal matter in a different court and he has not absconded.

The magistrate ordered the accused person to be detained in Capital Hill Police Station until December 18, 2024, when he will rule on bond application.
