Rose Mbithe, two children and cop charged over Dr Victoria Mutiso’s murder
The four suspects — Angela Mulwa, Rose Mbithe Mulwa alias Rose Mbithe Ndeti, Chris Mulwa and Elijah Kibelion Kimoi — appeared before Justice Kanyi Kimondo at the Milimani Law Courts, where the murder charge was read to them.
Machakos politician Rose Mbithe Ndeti, her two children and a police officer have been formally accused of the murder of renowned psychiatrist Dr Victoria Thunya Mutiso.
Mbithe appeared before the High Court in Nairobi yesterday, Thursday, August 27, 2026 alongside her children, Angela Mulwa and Chris Mulwa, both advocates of the High Court.
Police Constable Elijah Kibelion Kimoi was also presented before the court.
The four suspects — Angela Mulwa, Rose Mbithe Mulwa alias Rose Mbithe Ndeti, Chris Mulwa and Elijah Kibelion Kimoi — appeared before Justice Kanyi Kimondo at the Milimani Law Courts, where the murder charge was read to them.
They did not, however, enter pleas to the murder charge.
Justice Kimondo directed that the four suspects first undergo mental assessments before being presented before Justice Alexander Muteti, who is expected to take their pleas. The case will be mentioned on September 23 for plea-taking.
The judge further directed that PC Kimoi be provided with a pro bono lawyer after the court established that he did not have legal representation.
According to the charge sheet, the four are accused of murdering Dr Mutiso on July 29, 2026, at about 9:30am along Mawensi Road in Kilimani, Nairobi County.
The prosecution alleges that they acted jointly with other persons who have not yet been brought before the court.
The prosecution has preferred the charge under Section 203 as read with Section 204 of the Penal Code, which relate to murder and its prescribed punishment.
The appearance before Justice Kimondo was therefore procedural, with the court yet to receive the suspects’ formal responses to the allegations.
Dr Mutiso, a former Director of the African Institute of Mental and Brain Health, was fatally shot while inside a motor vehicle in the Upper Hill-Kilimani area of Nairobi.
Investigators recovered two spent cartridges and two bullet fragments from the scene, which were submitted for forensic examination.
A Mini Jericho pistol was later recovered and subjected to ballistic examination. According to the Directorate of Criminal Investigations (DCI), “the preliminary ballistic opinion links the recovered cartridge cases and bullet head to that firearm.”
Investigators say the firearm had been issued to a senior police officer who is currently at large.
Inspector Kenneth Kipkemboi Sang of Nderi Police Station and Collins Bett Kiplangat of Thogoto Police Station have been named as persons of interest and were, as of Monday, the subject of a police manhunt.
The investigation has also focused on a land dispute involving Dr Mutiso, with detectives identifying it as a possible motive for her killing.
According to investigators, Dr Mutiso was involved in a dispute over L.R. Number 1504/13, a property matter that is the subject of proceedings before a court in Machakos.
Detectives are also investigating an earlier incident in which Dr Mutiso reported an attempted attack on her life.
The DCI said that on July 7, 2026, she reported being confronted by two armed men riding a motorcycle near Junction Mall along Ngong Road, Nairobi. The men allegedly pointed a gun at her, but she managed to escape and subsequently reported the incident at Kilimani Police Station.
Investigators have alleged that PC Kimoi was one of the armed men involved in that earlier incident.
The DCI has also identified Dr Mutiso’s husband as a crucial witness in the ongoing investigation.
