Retired teachers want CS Rotich summoned over pending payments

Retired teachers now want the High Court to summon National Treasury Cabinet Secretary Henry Rotich to explain why he is “blocking” Sh42 billion awarded to them after they won a case against Teachers Service Commission.

Through a certificate of urgency filed before Justice Janet Mulwa in Nakuru, the retirees, through their lawyer Dominic Kimatta, said that Mr Rotich should appear in person because “he is the one blocking the payments.”

They accused the cabinet secretary of directing the money budgeted for payments of the retirees to other uses instead of settling the arrears claimed by the retirees adding that it is unfair.

“The cabinet secretary together with his Permanent secretary for finance are clearly blocking payments of my clients since the money budgeted for payments have been diverted with no clear explanation given,” said Kimatta.

In his application before the court, Mr Kimatta accused the TSC CEO Nancy Macharia and Director of pensions Shem Nyakutu of colluding with the Cs treasury to deny the retirees  the only glimpse of hope they had of receiving their money.

“I am worried when the TSC and the department of pension can willingly collude with the treasury to deny my clients their duly sweated efforts,” he added.

He urged the court to effect the arrest warrant against TSC CEO Nancy Macharia who was found guilty of contempt as previously ordered saying she has opted to work against the set agreements of the court.

“TSC CEO has refused to comply with court orders of paying my clients by leaving out names of retirees between July 1, 1997 and June 30 1998, that is clear contempt and should be arrested,” he said.
