Raila file petition at Supreme Court challenging Ruto’s win

Azimio One Kenya coalition leader Raila Odinga has today filed a petition at the Supreme Court challenging the declaration of Kenya Kwanza coalition leader William Ruto as President-elect.

Speaking soon after filing the petition, Odinga stated that the matter at hand is a do-or-die situation while revealing how some people were opposed to the idea of seeking legal justice.

“A short while ago, we successfully filed our presidential election petition at the Supreme Court of Kenya. The action we have taken is perfectly in line with the stipulations of our constitution on resolving disputes,” he stated.

The former premier was accompanied by his running mate Martha Karua, Kalonzo Musyoka, and other Azimio leaders.

The petition accuses Independent Electoral and Boundaries Commission (IEBC) chair Wafula Chebukati of usurping the role and functions of the commission by declaring results from the 27 constituencies that had not been tallied or verified by the commission.

“The presidential election results that were announced represent the continued struggle, pitting the forces for democracy and good governance against the corruption cartels that are so determined to take control of the government and this country,” Odinga said.

The Azimio leader further claims that at the time of declaring the final result of the presidential election, the IEBC had not received, uploaded, and made publicly available for scrutiny on the public IEBC portal Forms 34A of 27 constituencies.

The constituencies are; Mvita, Matuga, Kilifi North,Bura, Fafi, Wajir North, Eldas, Mandera West, Tigania East, Mbeere north, Ndaragua, Kapenguria, Kacheliba, Narok North, Narok South, Narok West, Kajiado East, Kandunyi, Nyakach, Rangwe, Ndhiwa, Suba North, Kuria East, Bomachoge, Borabu, Kitutu Chache North, and West Mugirango.

Odinga and his Azimio bandwagon are expected to serve respondents within one day, who will then have four days to file their responses.

The case will then be heard and determined on September 4, 2022.

This is Raila’s fifth time running and third time challenging his loss in presidential elections through the Supreme Court has filed a case after the last two elections in 2013 and 2017.
