Police chiefs finally appear in court as one of missing Mlolongo abductees found dead

One of the three people abducted in Mlolongo on December 16 last year, Justus Mutumwa Musyimi has been found dead, his family’s lawyer told the High Court in Nairobi.

Lawyer Dan Maanzo told Justice Chacha Mwita that Mutumwa’s body was found in Ruai area before it was moved to the Nairobi Funeral Home, formerly City mortuary.

“A quick search on the body has confirmed it is that of the missing man Mutumwa who is party to the case in court. This information has come to us as the case proceeded in court,” said Maanzo, who is also the Makueni senator.

He made the shocking revelation as Inspector General of Police Douglas Kanja and Director of Criminal Investigations Amin Mohamed finally appeared before the court where denied being aware of the whereabouts of the Mlolongo abductees.

Maanzo demanded a thorough investigation into the dead, adding that the family identified the body today (Thursday). An autopsy is planned on the body to establish how he died.

Mutumwa, Steven Mbisi Kavingo, Kalani Mwema and Martin Zyuko Mwau were reported to have disappeared r at Mlolongo police station and Athi River police station and have not been located yet.

Kanja told Justice Mwita that he received the information about the disappearance of the four and directed Assistant Inspector General Paul Wachira to lead in Investigations of the matter.

Wachira admitted that reports of missing persons were made in the said police stations and Investigations commenced immediately circulating the names of the four abductees to all police stations and police posts in the country. He confirmed that after the circulation they received information that the respondents were not in the hands of National Police Service.

Investigators also visited the scenes where the abductions took place and interviews was conducted and statements were recorded

They proceeded to another bit of Investigations where two inquiry files of missing persons were opened by the DCI.

“One file was opened by the DCI Athi River about the missing of Justus Musyimi and Martin Mwau who went missing on December 12, 2024,” Wachira stated

He added that the other file was opened at Mlolongo DCI bearing the names of Stephen Mbisi and Kalani Mwema.

He told the court that the matters are still under Investigations however they have been encountering some difficulties since the witnesses who could help with information voluntarily do not come up to give information.

On his part, Amin Mohamed told the court that he is aware of the matter and when it was reported they responded and commenced investigations, adding that Wachira was directed to be the lead investigator.

He confirmed to the court that investigations are still ongoing.

State prosecutor Mark Barasa  requested the court the Director of Public Prosecution’s office be struck out from the application as they are expecting the investigation file from the Inspector General of Police and were thus unable to proceed with the matter,

“Your honour personal application of harbeous corpus cannot be turned as a weapon to false proceedings in a certain direction,” Barasa prayed.

He prayed the court for the matter to be stayed to give them time to officially lodge their formal application.

Justice Mwita directed the ODPP to serve the submissions immediately and response by the other parties be made within seven days.

He further directed the hearing of the applications to be done virtually on February 12, 2025.
